FLOODPLAIN MANAGEMENT

Development Regulations

  • New and substantially improved structures must have the lowest floor at or above the Base Flood Elevation (100-year).
  • First floor flood elevation must be certified by a registered professional engineer or surveyor licensed in the State of West Virginia.
  • Enclosed areas below the Base Flood Elevation must be constructed with water equalizing vents and constructed of flood resistant materials by a registered professional engineer licensed in the State of West Virginia.
  • All floodways shall be preserved to carry the discharge of the 100-year flood.  New structures shall not be permitted without distinct engineering proof that the proposed structure will cause a 0.00' rise in the Base Flood Elevation.
  • All structures must be anchored in accordance with acceptable engineering practices to prevent flotation, collapse and lateral movement.
  • All electrical utilities, plumbing and H.V.A.C. must be elevated above the Base Flood Elevation.
 

The Floodplain Ordinance was established on September 24, 1991 with the following intent:

  • Promote the general health, welfare and safety of the community.
  • Encourage the utilization of appropriate construction practices in order to prevent or minimize flood damage in the future.
  • Minimize danger to public health and safety by protecting water supply, sanitary sewage disposal and natural drainage.
  • Reduce financial burdens imposed on the county, its governmental units and its resident by preventing the unwise design and construction of development in areas subject to flooding.

Mineral County has been an NIFP participating community since 1975.


Permit Procedure

A building permit is required for all development and is especially important in any flood zone

Applicants are required to complete a building permit in the Mineral County Assessors Office (first floor of the Courthouse).  A rough sketch of the proposed project should accompany the building permit.

Upon review of the permit, the Mineral County Planner may request a site plane drawn to scale.  This site plan must show the following:

  • Dimensions of the site
  • Size and location of existing & proposed structures
  • Setbacks (required distances from property lines and right-of-ways)
  • Existing ground contours
  • Delineation of the 100-year flood elevation boundary and the floodway limit (where applicable)
  • Proposed first floor elevation and method of elevation
  • Elevation of finished grade adjacent to the proposed project

Elevation Certificate

    An Elevation Certificate is an official form supplied by the Federal Emergency Management Agency (FEMA) to certify as-built flood elevation.  All applications for construction within any flood zone must be accompanied by and elevation certificate completed by a registered professional engineer or surveyor licensed in the State of West Virginia.

Penalties

  • Any person who violates any provision of the Mineral County Floodplain Ordinance may be subject to a fine of not less than $50.00 nor more than $500.00 plus the cost of prosecution.  Each day of non-compliance shall constitute a separate offense.
  • Increased flood insurance rate or the inability to obtain flood insurance.
  • Ineligibility for federal grants, loans, programs.
